Who this is for
Fixed-term early exit has several cost models
The estimator implements a standard NSW break-fee comparison from an actual weekly rent and a confirmed agreement-entry date for qualifying agreements entered after 23 March 2020 and lasting no more than three years. The fee is four, three, two or one weeks' rent according to the fraction of the term elapsed. Special lawful-exit grounds and agreements outside this scope require separate review.

Worked example
Illustrative scenarioIn a qualifying NSW term with 40% elapsed, the standard fee band is three weeks. At weekly rent 600 the comparison is 1,800; special termination grounds can change whether the fee applies at all.
Queensland reletting cap
From an actual weekly rent and a confirmed agreement-entry date, for qualifying fixed terms of no more than three years entered from 30 September 2024, the Queensland calculation uses a four/three/two/one-week reletting band, limited by rent until a replacement tenancy starts if that is lower. Without a replacement date, the tool shows a range up to the band rather than charging the full band as a known liability. It excludes permitted early termination and rooming accommodation.
Other jurisdictions and unknown costs
For other states and territories, the tool adds entered fees and a clearly labelled rent-loss scenario. SOURCE_REVIEW_REQUIRED remains visible: legal caps, actual loss, mitigation, exemptions, proportions and tribunal decisions are not calculated. ACT, SA and NT also have capped regimes in some circumstances; an entered-cost sum must not be treated as the recoverable amount. Victoria has enacted future changes which must not be activated before their commencement is verified.
Dates and evidence
The rent-loss scenario counts calendar days from the entered exit date to a replacement or contract-end date using weekly rent divided by seven. The contract last day is included, while elapsed term counts whole calendar days before the entered vacant-possession day. This is an estimating convention, not verified statutory date arithmetic: exact handover time and contract wording can alter a fee band near 25%, 50% or 75%. The agreement may define another method. The bond is not added as a fee; document the requested costs, replacement efforts and condition evidence separately. Entering fees never proves they are owed, and adding them to a capped model would risk double counting.
Frequently asked questions
Does the result decide my application or legal position?
No. It reports scoped arithmetic or source guidance. Your agreement, the recipient's assessment and applicable exceptions remain separate.
Are my entered figures sent with analytics?
The calculation runs in your browser. If you allow analytics, pseudonymous usage events contain the tool, market and an ephemeral attempt ID, not your amounts, documents or individual result.
